What Went Wrong? (a/k/a Don’t Let This Happen to You!) – Akke Levin, Denise Bradshaw & Joe Garin

This session reviews recent opinions and orders by the Nevada Supreme Court in attorney discipline cases.  The panel will then review some of the more notable cases involving lawyer misconduct throughout the country.  At the end of the session, participants will “shake their heads” at choices made by some lawyers and (the panel hopes) leave with the determination to never appear on “what went wrong” list as a result of engaging in risky behavior.


The Common Interest Rule in Nevada – Brett Kandt & Alan Freer

The Nevada Supreme Court recently adopted the common interest rule as an exception to waiver of the work-product privilege.  This session will review that opinion and the application and limits of the rule for practitioners.


Does Defending against Malpractice Allegations Trump the Duties of Confidentiality & Privilege? – Paul Hejmanowski

This session will analyze some of the issues present in the tension between a lawyer’s duties to maintain client confidentiality and preserve the attorney-client privilege versus the lawyer’s desire to defend against allegations of malpractice.
